Rules for using AudioCheats, including allocation of responsibility, liability framework and service scope.
These Terms of Use govern the use of AudioCheats as a digital web application operated by Bennett & Fleischhauer GbR.
AudioCheats is intended for users who want to manage, compare and reuse audio presets, mix starting points, own presets, notes and related working states.
AudioCheats provides public presets, own presets, notes, comparison and export functions, as well as account management. The specific feature set may evolve over time.
Where features are offered free of charge, there is no claim to permanent retention of individual free features, provided legitimate user interests are reasonably considered.
AudioCheats does not owe any specific commercial success, sonic result or fitness for a particular live, broadcast, studio, installation or event purpose unless expressly agreed in text form.
AudioCheats provides technical starting points, references and documentation aids. The content is intended to support orientation and workflow. In particular, the provision of presets, notes, comparison views or exports does not create an engineering contract, advisory contract, inspection contract, supervision contract, safety contract or any other result-based professional contract unless expressly agreed otherwise.
The content does not constitute binding instructions, approval for real signal paths or a guarantee of any specific acoustic, commercial, technical or operational result.
Before real-world use, every setting must be independently reviewed and adapted to the specific setup, room, signal source, volume, workflow, hearing protection and any other safety-related or operational requirements.
AudioCheats does not replace professional case-by-case judgment and must not be used as the sole basis for safety-critical, liability-sensitive, health-related, equipment-related or otherwise damage-prone decisions.
Responsibility for the actual transfer of parameters, gain structure, signal routing, dynamics processing, loudness, feedback behavior, hearing protection, system safety, hardware and software compatibility, event operations and compliance with local laws, standards and technical rules lies exclusively with the user.
Users may not use AudioCheats in a way where misunderstandings or unchecked transfers are typically capable of causing personal injury, property damage, equipment damage, financial loss or consequential damage without first carrying out an independent professional review.
Certain functions require a user account. Registration data must be complete and accurate.
Credentials must be kept confidential. Users must notify us without undue delay if unauthorized access or misuse is suspected.
Use is permitted only in compliance with applicable law and these Terms of Use.
In particular, abusive access, circumvention of technical protections, automated bulk use without permission, unlawful content and any use that impairs operation, security or third-party rights are prohibited.
For worldwide use, users remain solely responsible for ensuring that their use, content, exports and the practical implementation of information stored in AudioCheats are lawful in the country of use.
Users remain responsible for their own presets, notes and any other content they upload or store.
Users represent that their content does not infringe third-party rights and does not contain unlawful material.
Users shall indemnify us against third-party claims arising from their content, unlawful use, breach of these Terms of Use or an unchecked practical implementation of content stored in AudioCheats, unless we are responsible for the respective breach.
AudioCheats is provided with the aim of stable and secure operation. Continuous uninterrupted availability is not owed.
We may modify, further develop, restrict or temporarily suspend functions where required for technical, security-related, legal or operational reasons, while reasonably taking legitimate user interests into account.
Users are responsible for maintaining appropriate backups of their material content. Where export or download functions are offered, they are provided as support functions only and not as an independent guarantee of archiving, long-term availability or restorability.
All rights in AudioCheats, the software, design, structure and the content we provide remain with us or our licensors.
Users receive only a non-exclusive, non-transferable right to use the application in accordance with these Terms of Use.
Where mandatory consumer law applies, statutory rights relating to defects in digital products and other mandatory protective provisions remain unaffected.
We are fully liable for intent, gross negligence, injury to life, body or health, under the German Product Liability Act, and where a guarantee has been expressly assumed.
In the event of slight negligence affecting essential contractual obligations, liability is limited to the typical foreseeable damage. Essential contractual obligations are obligations whose fulfilment is necessary for proper performance and on whose compliance users may regularly rely.
In all other cases, liability for slight negligence is excluded to the extent permitted by law. This applies in particular to damage resulting from users transferring content, presets, exports or other information from AudioCheats into real technical, operational or event environments without their own expert review and adjustment.
To the extent permitted by law, we are not liable in cases of slight negligence for indirect losses, consequential losses, business interruption, loss of profit, loss of savings, reputational harm, data loss or third-party claims unless essential contractual obligations have been breached.
These liability rules also apply in favor of our legal representatives, employees and agents.
Users may terminate their account through the provided functions or by contacting us.
We may suspend or terminate accounts in the event of material breaches of these Terms of Use, security interests or legal requirements.
Information about the processing of personal data is available in the Privacy Policy.
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only to the extent it does not deprive them of mandatory protections of the law of their habitual residence.
If the user is a merchant, a legal person under public law, a special fund under public law or has no general place of jurisdiction in a Member State of the European Union, the exclusive place of jurisdiction for all disputes arising out of or in connection with these Terms of Use shall be Darmstadt, Germany, to the extent permitted by law.
Mandatory jurisdiction rules in favor of consumers remain unaffected.
